Fixed costs for clinical negligence

Get ready for a shake-up in October—fixed recoverable costs (FRC) are coming for clinical negligence claims under £25,000. The recent Civil Procedure Rule Committee meeting confirmed this, but it’s been a bumpy ride with delays pushing the rollout from this month to October. We’re still working out the kinks, aiming to finalize everything before summer ends. However, keep an eye out for any political curveballs that could throw a wrench in the plans.

Back in September 2023, the government announced plans to introduce FRC and simplify the process for smaller clinical negligence claims in England and Wales. They’re hoping to speed up case resolutions while making sure legal costs are fair. But not everyone is on board. Critics, like the Society of Clinical Injury Lawyers, argue that the proposals don’t go far enough in prioritizing learning and patient safety.

So, while changes are coming, there’s still some debate about whether they’ll hit the mark. Stay tuned for updates as we edge closer to October!

It sounds like there’s a lot of anticipation around these changes in clinical negligence claims. Do you think implementing fixed recoverable costs will really help streamline the process, or do you think it might create new challenges instead?

I think fixed costs just makes the the process smoother as calculating costs takes a lot time tbh

An interesting one! Do you actually think the FRC reforms will effectively balance efficiency and patient protection? Or do you think it may fall short in ensuring patient safety?

I think the FRC might be able to balance these, but, as you may know, there is always a small chance for failure unfortunately which cannot be overlooked.
